Terms and Conditions for One Mobile 5G Mobile Data Services

  1. Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between One Mobile(“we,” “us,” or “our”) and you, the customer (“you,” “your,” or “Customer”), governing your use of One Mobile’s 5G mobile data services (“Services”). By subscribing to or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional terms applicable to specific Service Plans. If you do not agree, please do not use our Services.

  1. Definitions

For the purposes of these Terms, the following definitions shall apply:

1.​   “Customer” refers to any individual or entity that subscribes to or uses our Services.

2.​ “Service Plan” refers to the specific mobile data plan selected by the Customer.

3.​ “Network” refers to One Mobile’s telecommunications infrastructure and related systems.

  1. Eligibility and Registration

3.1. To enter into this agreement and use our Services, you must be at least eighteen ( 18) years old and legally capable of forming a binding contract. By accepting these Terms, you represent and warrant that you meet these eligibility requirements before activation of Services which shall include providing valid identification documents and biometric data where applicable. One Mobile reserves the right to suspend or deactivate unregistered or incorrectly registered SIM cards.

3.2. All Customers shall be required to complete a mandatory SIM Card registration process

  1. Service Plans

4.1. One Mobile offers various Service Plans, which may differ in pricing, data allowances, validity periods, and other features. The details of these service plans can be found on our website or upon request, and are deemed incorporated into these Terms by reference.

4.2.     Service Plans may be subject to promotional offers, which will be clearly communicated at the time of subscription.

  1. Charges and Payment

5.1. Customers are responsible for paying all charges associated with their selected Service Plan, including any applicable taxes and fees.

5.2. Payments are due on a daily or monthly basis as the case may be and the necessary payments must be made by the due date to avoid service interruptions.

5.3. Failure to make timely payments may result in the suspension or termination of Services, at our sole discretion, without prejudice to any other remedies available to us under these Terms or applicable law.

  1. Usage Policy

6.1. The Services are intended for lawful and personal non-commercial use only. Commercial use may result in additional charges or service termination.

6.2. Customers must not use our services or SIM cards to generate artificially inflated traffic ​

6.3. Customers must not establish, install or use a gateway device or SIM box without the prior written consent of One Mobile (including devices tethered via cable, Bluetooth or WIFI, to a computer or the internet, when used for making large volumes of calls or sending large volumes of texts). One Mobile reserves the right to withhold consent for such activity at its sole and absolute discretion.

6.4. Customers must comply with all applicable laws and regulations when using the Services.

  1. Data Speeds and Coverage

7.1. While One Mobile aims to provide high-speed 5G data connectivity, actual speeds may vary based on factors such as network congestion, signal strength, and device capabilities.

7.2. Coverage is not guaranteed in all geographic areas in Sierra Leone.

  1. Data Limitations and Fair Usage

8.1. Some Service Plans may include data limits. Exceeding these limits may result in reduced speeds or additional charges.

8.2. One Mobile reserves the right to monitor usage of Customers to ensure compliance with these Terms, investigate suspected violations, and take any action deemed appropriate, including suspension or termination of Services and legal recourse.

  1. Customer Support and Complaints Procedure

9.1. Customers can contact One Mobile’s customer support team at +232 33 399 399 or 3333 for assistance with any issues or inquiries related to the Services.

9.2. All complaints and service-related concerns will be acknowledged within 72 hours and resolved within 21 business days unless additional investigation is required. If a resolution is not achieved, you may escalate the matter to the National Communication Authority (NATCA).

  1. Limitation of Liability

10.1. To the fullest extent permitted by law, One Mobile shall not be liable for any indirect, incidental, or consequential damages arising from or related to the use of the Services; loss of data, revenue, profits, or business opportunity; or Service interruptions or delays due to network failures, maintenance, or force majeure events. ​

10.2. Our total liability, whether in contract, tort, including negligence or otherwise, shall not exceed the amount paid by you for the Services in the preceding three (3) months.

  1. Force Majeure

11.1. One Mobile shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control (“Force Majeure Events”), including but not limited to natural disasters, acts of government or regulatory authorities, war, terrorism, civil unrest, labour disputes, power outages, pandemics, network failures not attributable to One Mobile, or any other similar events.​

11.2. During the period of the Force Majeure Event, One’s obligations under these Terms shall be suspended to the extent affected. If the Force Majeure Event continues for more than thirty (30) days, either party may terminate the affected Service Plan without liability, upon written notice to the other.

  1. Modifications to Terms

12.1. One Mobile reserves the right to modify these Terms from time to time to reflect changes in law, technology, or service features.

12.2. Customers will be notified of any material changes, and continued use of the Services after such notification constitutes acceptance of the revised Terms. You reserve the right to terminate your Service Plan if you do not agree to the changes. Mobile, subject to the settlement of any outstanding payments or charges accrued up to the termination date.​

  1. One Mobile may suspend or terminate your access to the Services immediately, without prior notice, if:
  2. You breach any material provision of these Terms;
  3. You fail to make timely payment of applicable charges;
  4. You engage in prohibited or unlawful use of the Services; or

d)​  Required byaw or upon request of regulatory authorities.

13.1. Upon termination, your access to the Services will be disabled, and you shall immediately cease using them. Any outstanding balances shall become immediately due and payable.​

13.2. Provisions of these Terms which by their nature should survive termination (including but not limited to Sections on Limitation of Liability, Dispute Resolution, and Governing Law) shall so survive.

   14. Governing Law These Terms shall be governed by and construed in accordance with the laws of Sierra Leone. Any disputes arising from these Terms will be resolved by arbitration.

  1. Dispute Resolution

Any dispute, claim, controversy arising out of or relating to this agreement or the breach of its terms thereof, shall be referred and submitted to and finally resolved by a sole arbitrator pursuant to the Arbitration Act in force in Sierra Leone at the time. The parties shall mutually agree on a sole arbitrator within fourteen (14) days after notification by either party of the existence of a dispute or disagreement. If no agreement is reached, either party may apply to the Chamber of Commerce in Sierra Leone to appoint the arbitrator. The arbitration will be conducted in English in Freetown, and the award shall be final and binding. Nothing in this clause prevents either party from seeking interim relief from a competent court. Any arbitral award rendered by the sole arbitrator shall be final and binding on the Parties.

  1. Regulatory Compliance

16.1. These Terms and Conditions and the provision of Services by One Mobile shall be governed by and conducted in accordance with the applicable telecommunications laws, regulations, and directives of the Republic of Sierra Leone, including but not limited to the guidelines and directives issued by the National Communications Authority (NATCA).
